General terms and conditions

1st area of application

These conditions of participation and contract apply to all bookings of courses that are not made exclusively online via the website of Technologie- und Ausbildungscampus Cuxhaven GmbH.

2. definitions

  • a) The provider is Technologie- und Ausbildungscampus Cuxhaven GmbH, Humphry-Davy-Straße 62, 27472 Cuxhaven.
  • b) A participant is any person who takes part in a course offered by the provider or has registered for such a course.
  • c) Course fees are the prices for a course.
  • d) External audit fees are fees incurred by third parties for audits to be carried out, e.g. public authorities, chambers of industry and commerce.
  • e) Internal examination fees are those that are incurred in addition to the provider's course fees when registering for an examination.
  • f) Other fees are those that do not fall under letters d) and/or e), but are incurred for taking an examination.

3. participation requirements

  1. Anyone can take part in the courses offered by the provider. The contract for a course is only concluded when the provider issues a declaration of acceptance. This must be sent by e-mail or letter post within 5 working days (receipt by the participant). If this is not done or the declaration of acceptance is not received in time, the contract is not concluded.
  2. If access requirements are necessary for a recognised qualification sought by the participant or if funding is to be claimed in accordance with the German Social Security Code III, these must be met. It is the participant's responsibility to check the entry requirements. If the participant does not fulfil these admission requirements, this does not release him/her from paying the course fees.
  3. By way of derogation from para. 2, the provider shall be responsible for checking the access requirements if the measures are subsidised by an employment agency.

4th registration

  1. In order to take part in a course, the participant must complete an application form. The terms and conditions of participation and contract are enclosed with this registration form. The validity of these is confirmed by the participant upon registration.
  2. The contract for a course is only concluded when the provider issues a declaration of acceptance. This must be sent by email or post within 5 working days (receipt by the participant). If this is not done or the declaration of acceptance is not received in time, the contract is not concluded.

5. resignation

  1. The participant has the right to withdraw from the course within 14 calendar days after conclusion of the contract (cf. No. 4. Para. 1 and 2) without giving reasons. If there are less than 14 calendar days between the conclusion of the contract and the start of the course, the right of cancellation ends at the end of the day preceding the day on which the course begins according to the calendar.
  2. The cancellation must be declared to the provider in text form (§ 126b BGB). Cancellation is deemed to have been made in good time if the provider receives the notice of cancellation within the specified deadlines.
  3. Participants in vocational training measures that are subsidised by the employment services in accordance with the German Social Security Code III may withdraw from the contract if the subsidy is not granted, notwithstanding the provisions in paragraph 1. No costs shall then be incurred as a result of the cancellation justified in this way. The rejection of the funding by the labour administration must be proven to the provider by the participant without delay (§ 121 para. 1 sentence 1 BGB).

6 Terms of payment and dunning

  1. The participant is obliged to pay the fee on time as follows:
    • a) Course fees at the latest at the end of the day preceding the day on which the course begins according to the calendar.
    • b) Examination fees on the day of registration for the examination,
    • c) External examination fees on request by the provider,
    • d) Internal examination fees on the day of registration,
    • e) Other fees upon request by the provider
  2. For courses lasting more than 3 months, payment in instalments is possible:
    • a) The number of instalments is equal to the number of months the course lasts.
    • b) The amount of each monthly instalment is calculated by dividing the course fee by the number of instalments.
    • c) Each individual instalment is due on the first day of each month of the instalment period, starting on the first day of the month in which the course begins.
    • d) If the participant is in arrears with more than two instalments, the agreed instalment payment shall be cancelled and the remaining course fee outstanding at this time shall become due immediately.

7 Cancellation and termination

  1. Training courses with a duration of up to 3 months cannot be cancelled prematurely. If a vocational training programme in accordance with the German Social Code III is divided into sections that are shorter than three months, it can be terminated at the end of each section.
  2. Courses with a duration of more than 3 months can be cancelled with a notice period of 6 weeks, for the first time at the end of the first three months and thereafter at the end of the next 3 months, without giving reasons.
  3. Example of the above at the start of the measure on 3 February:
    • 1st cancellation date: 21.03. to 02.05.
    • 2nd cancellation date: 21.06. to 02.08.
  4. The cancellation must be declared to the provider in text form (Section 126b BGB).
  5. Absence from lessons does not constitute effective notice of cancellation under any circumstances. Teachers are not authorised to accept notices of dismissal.
  6. In the event of cancellation, the fees will be charged until the end of the cancellation period.
  7. The right to extraordinary cancellation remains unaffected.

8 Course programme and changes

  1. The provider offers the instruction provided in a course in accordance with the course programme valid at the time the contract is concluded. The provider may make changes to the content of curricula as long as the objective of the course remains unchanged.
  2. If the provider makes changes before or during the course that alter the objective of the course, he must inform the participant of this in writing. The participant then has the right to withdraw from the contract within 14 days. The cancellation must be made at least in text form.
  3. The replacement of teaching or training staff does not constitute a material change within the meaning of para. 2.
  4. The provider reserves the right to cancel announced courses due to insufficient participation, sudden illness of teaching or training staff or other unforeseen disruptions. In this case, any fees already paid will be refunded.

9 Obligations of the participant

  1. The participant is obliged to
    • to observe the applicable house rules at the place of instruction,
    • to follow the instructions of the course organisers and their representatives,
    • attend classes regularly,
    • submit the required documents in good time and in full,
    • comply with the provisions of vocational training and school law,
    • obligations in the context of contract measures for third parties.
  2. Participants who repeatedly violate these obligations may be excluded from lessons.
  3. The provider reserves the right to assert claims for damages due to a breach of the obligations mentioned in paragraph 1.
